The Augusta man who admitted to the 2007 rape has been sentenced to prison

WICHITA, Kan. (KWCH) – A man who pleaded guilty earlier this year to a 2007 rape was sentenced last Friday to 310 months — more than 25 years — in prison.

Ted Foy, a 54-year-old Augusta man, pleaded guilty March 20 to aggravated criminal sodomy, rape, aggravated sexual assault and attempted rape of a woman he did not know.

On November 13, 2007, around 11:00 p.m., Wichita Police responded to a sexual assault call in the 1900 block of South Tara Falls, where they learned that someone had broken into a home and sexually assaulted a woman. As part of the plea deal, Foy had to reveal how he chose his victim and how he knew where she lived. Foy said she was wearing black clothing and a black mask when she entered the victim’s home through a ground-floor window while her husband, who served in the military, was away.

Foy’s arrest in May 2023 was the first for Wichita police to use investigative genetic genealogy in which a DNA sample from an unsolved case is matched with data people have submitted to genealogy websites. Foy’s identity was confirmed through the DNA he left on the victim’s body.
